MAB+ STREAMING SERVICES PRIVACY POLICY

MAB+ (“MAB Plus, MAB Productions,” “we,”) values your privacy. In this Privacy Policy (“Policy”), we describe how we collect, use, disclose, and otherwise process the personal information described below, as well as the rights and choices you have regarding such personal information.

A. CCPA Privacy Notice for California Residents

1. Scope

This Privacy Policy applies to our collection, use, and disclosure of personal information related to the “Services,” which include:

  1. MAB+’s streaming services and content, available online, through desktop computers, tablets, mobiles and via certain third-party streaming platforms and services, including www.mabplus.com MAB+ mobile apps, and other apps and channels we make available through third-party platforms (e.g., Roku) and streaming services (collectively, “MAB Plus”);
  2. Our marketing, advertising, and promotional activities, such as email marketing campaigns, online advertising, contests, and other promotions, as well as any surveys, market research, and analysis we conduct; and
  3. Customer service, troubleshooting, and other interactions with current, past, and potential users of our Services.

This Policy does not apply to any third-party platforms, streaming services, websites, or online services maintained by other companies, which may be accessible from our Site or other Services or through which MAB+ or the Services are available.

Your use of our Services and any privacy-related disputes are subject to this Policy and our Terms of Use, including applicable limitations on damages and dispute resolution.

2. Collection of Personal Information

We collect information directly from you, from third parties (such as social media platforms, streaming device providers, and operators of certain third-party services we use), and through automated means, as detailed below.

A. Personal Information Collected Directly

The personal information we collect from you depends on how you use our Services or engage with us but generally includes:

  1. Registration and Profile Information:
    You can access and view MAB+ by creating an account and profile to save favorites, history, and preferences across platforms and devices. If you register for an account with us, we collect certain personal information from you, including your name and username.
  2. Communications and Interactions:
    When you communicate or interact with us, whether through the Site, email, or other means, we collect and maintain a record of your contact details (if provided), communications, and our responses. For example, we keep records of communications and information you post in other areas of the Services, as well as on our social media channels, and any information you provide related to customer service or support requests.
  3. Promotions and Surveys:
    If you participate in sweepstakes, contests, or promotions we offer, we may collect your name, age, email address, and other registration information you provide in connection with such contests, sweepstakes, and promotions. We may also conduct surveys to evaluate, develop, and improve our Services and better respond to audience preferences. If you respond to surveys or similar requests, we collect any personal information you provide, including your name, contact information, and survey responses.
  4. Events and Other Requests:
    For example, if you register for or attend an event we host or sponsor, we may collect information related to your registration and participation in that event. When you fill out a “Contact Us” form, subscribe to our mailing lists, or request information otherwise, we collect and maintain records of your requests.

B. Personal Information from Third-Party Sources

We collect information about you from other sources, such as public sources, business partners, advertisers, and third-party platforms. For example, we may collect information from the following sources:

  1. Operators of Platforms Distributing MAB+:
    If you access MAB+ through third-party platforms or devices, such as app stores (e.g., iOS and Android), streaming services, streaming devices (e.g., Roku), cable and internet providers, smart TVs, we may receive data about you and your device from the respective platform operator, including your country/location, user ID, other identifiers, and device information.
  2. Vendors and Service Providers:
    We outsource some of our operations to service providers and vendors, and we use certain third-party platforms to operate our Services. These providers may collect and provide us with IP addresses, unique identifiers, and other information about user activity.
  3. Data Providers, Ad Networks, and Other Advertising Partners:
    We may receive IP addresses, device IDs, other unique identifiers, and information about you, such as online activity, interests, household information, and demographic data.
  4. Third-Party Advertisers and Advertising Services:
    We also work with third-party advertisers that show ads through MAB+. These advertisers and advertising services may provide us with data about individuals to help us personalize and measure ads across the Services, as described further below.
  5. Social media and Other Third-Party Platforms:
    If you post information about us or interact with us on social media or other third-party platforms, or choose to link or log in to our Services with a third-party account (e.g., Google), we may collect personal information about you from that third-party platform. These platforms control the information they collect and share about you. For details on how they use and disclose your information, including any information you make public, refer to their privacy policies.

C. Personal Information We Collect Automatically or Derive

We automatically collect personal information related to your use of our Services and interactions with us and others, including information we collect using cookies and pixel tags. We may also derive information about you (e.g., preferences, interests, and demographic data) and your use of the Services. Such information includes:

  1. Device and Browsing Information:
    We use cookies, third-party SDKs, pixel tags, and other tracking technologies to automatically collect personal information when users access MAB+ or use our Site and other Services. This information may include IP addresses and other unique identifiers, general location information (and, in some cases, device geolocation data), browser type, domain names, access times, page views, timestamp information, operating systems, language, mouse clicks, mouse movements, scrolling activity, device type (e.g., network devices, computers, or other MAB+-compatible devices you may use to access our Services), unique IDs, internet service provider, referring and exit URLs, and similar device and usage data.
  2. Activities and Usage:
    We collect information about activity related to your use of our Services, such as links clicked, searches, features used, pages viewed, time spent, and files uploaded. We also collect information about your activity related to your use of our Services, such as title selections, programs viewed, ads viewed (if applicable), and search queries. We may use analytics providers and technologies, including cookies and similar tools, to collect this information. Note that we do not share users’ viewing history with third parties without users’ consent.

3. Purposes of Collection and Use
In general, we collect, use, disclose, and otherwise process information, including personal information, for the following purposes:

  1. Providing Services and Support: For example, to deliver and maintain our Services, optimize streaming and content availability, comply with platform-related requirements set by Platform Operators, improve our Services, conduct technical operations, and for other maintenance, service, and support purposes.
  2. Communicating with You About the Services: For example, to send notifications, updates, security alerts, and other administrative messages, as well as to respond to your comments and requests. We may also send surveys and questionnaires to users for purposes such as market research or customer satisfaction.
  3. Analysis and Improvement: To better understand how users access and use our Services, and for other research and analysis purposes, such as evaluating and improving our Services and operations, developing additional products, Services, and features, as well as for internal quality control and training purposes.
  4. Personalization: To tailor the information and content we display to users, including making content recommendations and to better understand user preferences and interests, enabling us to customize content and advertisements within the Services.
  5. Advertising Services: To display ads (including personalized ads) through the Services and on third-party websites, mobile apps, platforms, and devices, as well as to measure and understand the reach and effectiveness of these ads and provide analysis and reports to advertisers and advertising partners. We also assist advertisers and advertising partners in reaching their target audiences and improving their ad campaigns. To achieve this, we may associate browsers and devices (such as smart TVs, streaming devices, smartphones, and other devices) used by the same individual or household to deliver better-targeted ads across different browsers or devices and limit the number of times the same ad is shown.
  6. Marketing and Promotions: For marketing and promotional purposes, including sending news, updates, alerts, and promotional information via email and text message about the Services or products, services, and offers from MAB+ and our partners that may interest you, as well as to evaluate, measure, and improve our marketing efforts.
  7. Security and Protection of Rights: To protect the Services and our business operations, including preventing and detecting fraud, abuse, and unauthorized activities, as well as when we believe it is necessary to investigate, prevent, or address illegal activities, suspected fraud, situations involving potential threats to the safety or legal rights of any person or third party, or violations of our Terms of Use or this Policy.
  8. Compliance with Legal Obligations: To comply with the law and our legal obligations. For example, we may record, retain, and disclose information in response to subpoenas, court orders, and other legal requests from regulators and law enforcement.

4. Information Disclosure

We may disclose the information we collect, including personal information, to others as reasonably necessary for the purposes described above and as indicated or authorized by you, which may include:

  1. Vendors and Service Providers: To vendors, service providers, contractors, or agents who process such information on our behalf to provide us with services or perform functions on our behalf, including IT service providers, content delivery networks, analytics providers, and data vendors we work with to enhance our data.
  2. Platform Operators: If you access MAB+ or our Services through third-party platforms, websites, and other devices, we may disclose certain information to them, including activity and usage data, IP addresses, device identifiers, preferences, and privacy settings, to coordinate the provision of Services to you, personalize your user experience, and tailor advertisements to you. Depending on the Platform Operator’s services you use, we may also share information to suggest content and features available in our Services on the Platform Operator’s user interface.
  3. Advertisers, Advertising Networks, and Advertising Partners: To advertisers, advertising networks, and other advertising companies (“advertising entities”), as well as Platform Operators, with whom we work to show you ads that may interest you—including ads about MAB+ products and services and third-party products and services—within the Services and on other websites, apps, and devices. We may disclose information to these advertising entities and Platform Operators, and, in some cases, they may set and access their cookies, pixel tags, and similar technologies on the Services and collect or access information about you across time and different online services and devices.
  4. Advertising Measurement Providers: To advertising measurement providers and other vendors who help us and advertising entities understand information about the content and ads viewed, as well as the effectiveness of advertising campaigns, including the audience that viewed the ads and how they responded. These measurement providers collect or receive information about your viewing or interaction with content and ads within the Services and through our advertising services on other websites, mobile apps, and platforms. Measurement providers use your information to create metrics on what content and ads are being viewed to understand the audience and measure ad effectiveness.
  5. Protection of Rights and Interests: To law enforcement and others when we believe it is necessary to protect the Services, our rights, and property, or the rights, property, and safety of others. For example, to (i) prevent, detect, investigate, and respond to fraud, unauthorized access and activities, illegal activities, and misuse of the Services, (ii) situations involving potential threats to the health, safety, or legal rights of any person or third party, or (iii) enforce, detect, investigate, and respond to violations of our Terms of Use. We may also disclose personal information in connection with litigation and other claims or legal proceedings in which we are involved, as well as for internal accounting, auditing, compliance, record-keeping, and legal functions.
  6. Legal Compliance: To regulators, law enforcement, and other third parties to comply with applicable legal or regulatory obligations, including as part of a judicial process, in response to a subpoena, court order, or other legal process, or as part of an investigation or request, whether formal or informal, by law enforcement or a government official.
  7. Business Transfers: We may disclose your information to another entity in connection with an acquisition or merger, sale or transfer of a business unit or assets, bankruptcy proceedings, or as part of any other similar business transfer, including during negotiations related to such transactions.

5. Aggregate and Non-Identifiable Information

We may collect, use, disclose, and otherwise process aggregate and de-identified information for marketing, advertising, research, compliance, or other purposes. When we use, disclose, or process data that has been de-identified, we will maintain and use the information in a de-identified form and will not attempt to re-identify the information, except as permitted by applicable privacy laws.

6. Cookies, Targeting, and Analytics

We and our third-party service providers use cookies, pixels, JavaScript, and other mechanisms to automatically collect browsing, activity, device, and similar information within our Services. We use this information to analyze and understand how users access and use the Services, interact with others through our Services, identify and resolve errors, and evaluate, secure, protect, optimize, and improve the performance of our Services.

Cookies

Cookies are alphanumeric identifiers that we transfer to your device’s hard drive through the Services for record-keeping purposes. Some cookies facilitate navigation within our Services, while others allow us to track your activities on our Services, support security and performance, or collect activity and usage data within the Service. Most web browsers automatically accept cookies, but you can modify your browser options to block them in the future. The Help section of your browser’s toolbar will explain how to prevent your computer from accepting new cookies, how to notify you when a new cookie is received, or how to disable cookies entirely.

Pixel Tags

Pixel tags (sometimes called web beacons or clear GIFs) are tiny graphics with a unique identifier that function similarly to cookies. Unlike cookies, which are stored on your device, pixel tags are embedded invisibly on web pages and online content. We may use these tags in connection with our Services to track the activities of site visitors, help manage content, and compile usage statistics. We and our third-party service providers also use clear GIFs in HTML emails sent to customers to track email response rates, identify when emails are viewed, and determine if emails are forwarded.

Third-Party Analytics

We may use non-affiliated analytics companies, such as Google Analytics (see their privacy policy and opt-out options), to evaluate the use of our Services. These tools help us understand how our Services are used and improve performance, advertising campaigns, and user experiences. These entities may use cookies and other tracking technologies, such as web beacons or local storage objects (LSOs), to provide their services.

Advertising and Targeting

As described above, we work with third parties, such as advertising networks, channel partners, analytics and measurement services, and other third-party advertising companies, to customize content and display ads within our Services and manage our advertising on third-party online sites and services. We and these third-party advertising companies may use cookies, pixel tags, and other tools (collectively referred to as “targeting cookies”) to collect activity information within our Services (and on third-party sites and services), as well as IP addresses, location information, unique identifiers, cookie and advertising IDs, and other identifiers. This information is used to provide you with more relevant ads and content within our Services and other online services, as well as on third-party sites and apps, and to measure the success of these ads and content.

Preferences

We provide several ways for you to manage your preferences regarding third-party advertising and cookies within our Site and Services. Many of these methods are browser- and device-specific, meaning you need to set the preference for each browser and device you use to access our Site and Services. Additionally, if you delete or block cookies, you may need to reapply these preferences. Opting out of cookies and advertising, as described below, does not mean you will stop receiving advertising content from us. You may still receive generic or “contextual” ads from us.

  1. Browser Settings
    To prevent cookies from tracking your activity on our Site or your visits to multiple websites, you can configure your browser to block certain cookies, notify you when a cookie is set, or delete cookies. Visitors to our Site and other online services who disable cookies can still browse the Site, but some features may not function properly.
  2. Mobile Applications
    Our apps may include third-party advertising and personalization. You can opt out of targeted advertising in our mobile app through in-app settings or by adjusting your device’s privacy settings (refer to your device settings for more information). This means you will no longer receive targeted ads in the app; however, you may still receive contextual or general ads.
  3. Industry Advertising Choice Programs
    You can control how participating third-party advertising companies use the information they collect about your visits to our Sites and third-party sites to show you more relevant targeted advertising. For more information and to opt out of targeted ads from participating third-party advertising networks, visit http://aboutads.info/choices (Digital Advertising Alliance). You can also download the DAA AppChoices tool to help control interest-based advertising in apps on your mobile device.
    1. Please note that opting out of participating ad networks does not mean you will stop receiving advertising. You may continue to receive generic or contextual ads on our Services. Additionally, you may still receive targeted ads on other websites from companies that do not participate in the programs mentioned above.
  4. Custom Lists and Matching
    Subject to applicable law, we may share certain customer list information (such as your email address or other contact information, which is usually encrypted when shared) with third parties so we can better target ads and content to our Users and others with similar interests, within their services and other third-party platforms and services. These third parties use the personal information we provide to help us deliver targeted ads and enforce their terms, but we do not allow them to use or share the data we send to target ads to third parties. You may opt out of this as outlined in Section 7, “Your Privacy Choices.”

7. Your Privacy Choices

Users have several choices regarding their personal information and privacy preferences, as described in this section. Residents of certain jurisdictions have additional rights, as outlined in Section 13, “Additional Information for Residents of Certain States.” If you are a California resident, refer to Section 13.A, “CCPA Privacy Notice for California Residents,” for specific information about your California privacy rights and how to exercise them.

Marketing Communications

We may send you periodic promotional emails. You can opt out of receiving these communications by following the opt-out instructions included in the email or contacting us at [email protected]. Please allow up to ten (10) business days to process opt-out requests. Even if you opt out of promotional emails, we may still send you emails about your account or Services you have requested or received from us.

Accessing and Updating Your Account Information

If you register for an account with us, you can access and update certain account-related information in your account settings. Note that we may retain copies of information you have updated, modified, or deleted as permitted in our business records and as part of normal business operations.

8. Children

Our Services are intended for a general audience. We do not allow minors to register for a MAB+ account or create a child profile. In compliance with the Children’s Online Privacy Protection Act (COPPA), within MAB+, we (or our service providers acting on our behalf) may collect persistent identifiers but no other “personal information” as defined under COPPA.  Under COPPA, we collect and use these persistent identifiers to provide the requested Services and content and to support our internal operations. If you believe we have improperly collected personal information from a child under 13, please email us at [email protected] and we will take steps to securely delete such information.

9. Third-Party Sites and Services

Our Services may contain links to third-party websites. Any access to and use of such linked sites is not governed by this policy but rather by the privacy policies of those third-party websites. We are not responsible for the information practices of such websites.

10. Security

We have implemented security measures designed to protect the personal information we collect from loss, misuse, unauthorized access, disclosure, alteration, and destruction. However, please note that despite our best efforts, no data security measures can guarantee 100% security. You should take steps to protect yourself against unauthorized access to your password, phone, and computer, such as logging out after using a shared device.

11. Changes to This Policy

This Policy is effective as of the Effective Date listed above. We may update this Policy from time to time, so please review it periodically. We will post any changes to this Policy on our site. If we make changes that materially affect our practices regarding the personal information we previously collected from you, we will strive to notify you in advance, either by email or through a prominent notice on the site.

13. Additional Information for Residents of Certain States

Residents of certain U.S. states (including Virginia, Colorado, Connecticut, and Utah) may have additional rights under applicable privacy laws, subject to certain limitations. These rights may include:

  1. Correction: Correct inaccuracies in your personal information, considering the nature and purposes of processing the personal information.
  2. Deletion: Delete your personal information provided to or obtained by us.
  3. Access: Confirm whether we are processing your personal information and obtain a copy of your personal information in a portable and, to the extent technically feasible, easily usable format.
  4. Opt-Out: Opt-out of certain types of processing, including:

– The “sale” of your personal information.

– Targeted advertising by us.

– Any processing of personal information for purposes of making decisions that produce legal or similarly significant effects.

A. CCPA Privacy Notice for California Residents

California Residents’ Rights

California residents have the right to receive specific information about how their personal information is used and disclosed and not to be discriminated against for exercising their privacy rights under the California Consumer Privacy Act (CCPA). The CCPA also grants California residents the following rights (subject to certain limitations):

1. Opt-Out of Sales and Sharing:

The right to opt out of the sale and sharing of your personal information.

2. Delete:

Subject to certain exceptions, the right to request the deletion of your personal information that we have collected about you.

3. Know/Access:

The right to request and, subject to certain exemptions, receive a copy of the specific pieces of personal information we have collected about you, delivered either (a) by mail or (b) electronically in a portable and, to the extent technically feasible, easily usable format that allows you to transmit this information to another entity without hindrance.

California residents also have the right to request information about how we have handled their personal information, including:

– Categories of personal information collected;

– Categories of sources of personal information;

– Commercial and/or business purposes for collecting and selling their personal information;

– Categories of third parties to whom we have disclosed or shared their personal information;

– Categories of personal information disclosed or shared with a third party for business purposes; and

– Categories of third parties to whom personal information has been sold or shared, along with the specific categories of personal information sold or shared with each third party.

4. Correct:

The right to request that a business holding inaccurate personal information about you correct such information.

Submitting CCPA Requests to Know, Correct, and Delete

California residents may submit a verifiable request to exercise their rights under the CCPA as follows:

When submitting a request to know, delete, or correct, we will take steps to verify your request by comparing the information you provide with the information we have in our records. To verify your request, we may ask you to provide your name, email address, and contact details and to confirm your email address. In some cases, we may request additional information to verify your request or when necessary to process it.

Authorized agents may submit a request on behalf of another individual by contacting us in writing at the above-provided contact information. Authorized agents will be required to provide proof of authorization, and we may also require the relevant consumer to verify their identity and the agent’s authority directly. We will respond to verifiable requests received from California residents as required by law. If we cannot properly verify a request, we will notify the requester.

Requests to Opt-Out of Sales and Sharing

California residents may submit requests to opt out of the “sale” and “sharing” (e.g., targeted advertising) of their personal information by:

  1. Email: You can opt out of our sales and sharing of your personal information by sending a request to [email protected] We will process your request based on the personal information linked to or reasonably linkable to the personal information provided in your opt-out request.

California Shine-the-Light Law Rights

Under California’s “Shine the Light” law (California Civil Code § 1798.83), California residents who provide certain personal information have the right to request and obtain, free of charge, information about the personal information (if any) we have shared with third parties for their direct marketing purposes. Such requests may be made once per calendar year to obtain information about any relevant sharing with third parties in the previous calendar year.
